Deferred prosecution supervision is provided primarily to first time offenders who have committed misdemeanor offenses as well as those juveniles who have had two or more municipal court referrals. Also, students in the Juvenile Justice Alternative Education Program, who have not been probated, are offered supervision services. Juveniles who are offered deferred prosecution supervision receive ongoing case management by a probation officer for three to six months, as allowed by law. Supervision generally consists of regular office visits, in addition to visits by the probation officer to the child’s home and school. The probation officer may utilize resources of the department and the community as appropriate for the needs of the child and family. Should a juvenile fail to comply with the rules of the supervision agreement or if the juvenile commits a new law violation, the matter will be referred to the District Attorney’s Office.
